By hiring Keetch Miller Photography (the Photographer), the Client is agreeing to the following terms and conditions. 

 

Rates and Payment Schedule:

The Client agrees to pay the non-refundable retainer and session fee of $350 to book date, and secure and cover the services of Keetch Miller Photography. After the gallery of photo proofs is delivered to Client via an online gallery, the Client agrees to select and pay for the Collection within 5 days of gallery delivery. The second and final payment amount is determined by the collection selected by the Client. Rates are subject to change without notice. The Client will receive rates posted at the time of booking. In the event of cancellation, the retainer fee payed is non-refundable. Client agrees to pay a fine of $100/day to keep the proof gallery active if a collection hasn't been selected after 5 days. After a collection is selected and purchased, the online gallery of photos will be active and accessible for a year. 

Limits of Liability:

Photographer is not liable for any unplanned delays or cancellations due to extreme weather, transportation complications, or any other unforeseen events. In the unlikely event that the photographer is unable to perform services due to these factors, severe illness, injury, family crisis, or emergency, Keetch Miller Photography will make every effort to reschedule the session. If this is not possible, responsibility and liability is limited to the return of all payments received for the session.  In the unlikely event that photographs or files have been lost, stolen, or destroyed for reasons within or beyond Photographer’s control, The Photographer’s liability is limited to the return of all payments received for the session.

Model Release:

The photographs taken by Keetch Miller Photography may be used for the purposes of display, advertising, portfolio, instructional use, website or any publication or contest to promote Keetch Miller Photography. The Photographer will never display the photographs in a negative or derogatory light, or use the photographs for further financial gain outside of promoting Keetch Miller Photography. The Client hereby releases Keetch Miller Photography from all claims and liability relating to said photographs. 

Photographs and Copyright:

All photographs and copyrights are the property of Keetch Miller Photography. The Client has permission to reproduce photographs from this portrait session for personal use.  The Client agrees to limit use of the photographs for family and friends only.  Any use for business or for monetary gain will be considered copyright infringement.  The Client must obtain written permission from the Photographer and compensate the Photographer prior to the Client or the Client’s friends and family publishing or selling the photographs.

Hi-Resolution Images and Image Processing:

Once a Collection is purchased, the Client will receive the edited hi-resolution images in JPEG form . Photographer will never deliver RAW image files, as these are seen as the raw material in which the final product is made. High-resolution images may contain a mixture of color and black and white images edited at the Photographers discretion. An alternately colored version of a photo may be purchased at the current rate from the web gallery provided by the Photographer. Limited color correction and/or retouching are included at Photographer’s discretion. Client may request further changes within reason for an additional charge. Photographer is not responsible for any prints that are not ordered directly from her (the online photo gallery). For best results, the Client with the high-resolution files should order prints through a reputable lab. The Client is obtaining photographs for personal use only and shall not sell prints or authorize any reproductions by parties other than Keetch Miller Photography.

No Warranty of Longevity/Storage:

Keetch Miller Photography does not warrant the longevity in quality of any digital media or files delivered to the Client.  The Client bears the sole responsibility for backing up, archiving, and maintaining the integrity of the files. The Photographer will store digital photograph files for 90 days as a courtesy, but will not be held liable for storing these files.
